FURY LEAGUE QUALIFYING SEASON CASH LADDERS


Your participation in Fury League Qualifying Season Cash Ladders ("Fury League") is conditioned on your acceptance of the terms set forth in these Competition Rules ("Rules"). By entering Fury League (by clicking "ACCEPT" below or competing in the Fury League games), you are agreeing to these Rules and confirming your eligibility to enter Fury League in accordance with these Rules. If you do not agree to the terms of these Rules or if you do not meet the eligibility requirements, you must not compete in Fury League and when offered a choice, select "DECLINE", in which case you will be prevented from participating in Fury League.

1. Eligibility
Fury League is open only to legal residents of the United States (excluding Maryland and Vermont), Canada, Australia, New Zealand, the United Kingdom, Austria, Belgium, Denmark, Finland, France, Germany, Ireland, Italy, the Netherlands, Norway, Portugal, Spain, Sweden, Switzerland and other countries where Paypal Inc accounts are accepted ("Eligible Locations") who are at least 14 years of age as of 15 May, 2008. If you are not a legal resident of an Eligible Location or if you are 13 years of age or younger as of 15 May, 2008, you are not eligible to enter Fury League.

If you are a minor in your jurisdiction of residence, then, prior to participating in Fury League, a parent or legal guardian must submit to Auran Games Pty Ltd (ABN 73 081 393 311), the Fury League sponsor ("we", "us" or "Auran"), at the address and contact details below, a signed, written acknowledgement of their acceptance - on their and your behalf - of these Rules.

You also are not eligible to enter Fury League if the laws of any jurisdiction within an Eligible Location of which you are a legal resident prohibit us from offering or running Fury League, or awarding any prize, in that jurisdiction. Void where prohibited by law.

Auran employees and their families, and the employees of Auran affiliates, are permitted to enter Fury League but cannot win prizes of any nature. Affiliates include any company involved in publishing, distributing, marketing, hosting, testing, operating or supporting Fury League

We reserve the right to suspend your access to and participation in Fury League if your eligibility is in question, if you have been disqualified or if you fail to comply with these Rules, the End User License Agreement or the Terms of Use.


2. Contest Period
Fury League will occur over two periods. The first contest period will commence on 20 May, 2008 at 12:01pm American Pacific Standard Time (APST -- UTC - 8) and continue through and until 26 May, 2008 at 10:59pm APST (the "First Contest Period"). The second contest period will commence on 27 May, 2008 at 12:01pm APST and continue through and until 2 June, 2008 at 10:59pm APST (the "Second Contest Period"). Collectively, the First Contest Period and Second Contest Periods are the "Contest Period."

We may shorten, lengthen or postpone the Contest Period at our discretion, by providing notice on www.FuryLeague.com.


3. Minimum Player Entries
Fury League is a skill based competition offering cash prizes. These prizes are being offered by Auran to encourage players to play the latest improvements and updates to Fury.

In order to commence the competition, a minimum of two thousand (2,000) players must complete at least ten (10) matches in either the Vortex or Elimination 4v4 game types between May 13, 2008 at 2008 at 12:01pm American Pacific Standard Time (APST -- UTC - 8) and the commencement of the First Contest Period (the "Minimum Entries").

If less than 2,000 players complete ten (10) matches during this period, then Fury League will be cancelled or postponed at our sole discretion.

The games played prior to the First Contest Period do not count towards prizes in any way, and players who do not play ten games during this period are still eligible to enter Fury League.

Winners of Fury League will be based solely on your performance during the Contest Period, in accordance with clauses 5 and 6 of these Rules.


4. How to Enter Fury League
To enter you must (a) be eligible in accordance with clause 1 of the Rules, (b) agree to these Rules, and (c) hold a Fury account.

Players may only enter Fury League once. Any use of duplicate accounts will disqualify all accounts related to that player. Players will be asked to verify their name and address prior to allocation of prizes.

5. How to Win
Fury League is exclusively a contest of skill to determine the best individual players of Fury during the Contest Period based upon final Ladder position (as defined below).

For Fury League, we will operate only one ladder at a time. During the First Contest Period, the Vortex game type Ladder will operate. Winners will be determined by player position on the Ladder at the end of the First Contest Period. During the Second Contest Period, the Elimination 4v4 game type Ladder will operate. Winners will be determined by player position on the Ladder at the end of the relevant Contest Period. (i.e performance on the Elimination Ladder during the First Contest Period does not count and performance on the Vortex Ladder during the Second Contest Period does not count

An individual entrant's final position on any particular Ladder is based on his or her best-10 performances in the relevant game type over the course of the relevant Contest Period. For clarity, only games played during the relevant Contest Period, and his or her best-10 performances in such game type during that period will be used to determine his or her position on the relevant Ladder.

We may post live Ladder standings during the First Contest Period and the Second Contest Period but only the final Ladder standings at the end of the Second Contest Period will determine Fury League winners.

A player's score in any game is based on their skill rating versus their opponent's skill as determined using Auran's implementation of the GLlCKO-2 system, or such other system or method as we may in our sole discretion determine. Generally, defeating other individuals will result in a better score than being defeated; defeating another player with a high skill rating will result in a better score than defeating another player with a low skill rating; and losing to a more highly rated player will result in a better score than losing to a player with a lower skill rating.


6. Prizes
Prizes will be awarded to the top players on the Vortex Ladder at the end of the First Contest Period and to the top players on the Elimination Ladder at the end of the Second Contest Period.

There are no Clan-based prizes for this Fury League season.

Specific prizes will be announced on www.FuryLeague.com on or before the commencement of the First Contest Period.

Prizes will be delivered by means of email to the player's registered Fury Account email Billing Address. Player's must ensure that they have an active PayPal account and that their Fury Account email Billing Address matches their Paypal account email.

Players who do not have a valid Paypal account or use the incorrect or non-matching email address for their Auran or Paypal account will forfeit their prize. We are under no obligation to reallocate those prizes that are not redeemed.

We are under no obligation to distribute prizes if, in our reasonable opinion, there are no winners. Circumstances in which we would not be obligated to distribute prizes include, but are not limited to, where (a) there is cheating by multiple or an indeterminate number of persons which makes it impossible to conclusively determine winners, or (b) there are technical, hardware, software, communications, network, connectivity or other problems which interfere or prevent Fury League from operating as intended.

Prizes may only be redeemable by those who have established a Fury account with us in accordance with the Terms of Use. And who meet the eligibility requirements and payment requirements outlined in these conditions.


7. Notification of Winners
Winners will be notified by email, at the email address that the winners have registered with us during the Fury account sign-up process. Results of Fury League will also be posted at www.FuryLeague.com. You consent to our posting of your username on www.FuryLeague.com if you are a winner.

Prior to arranging for delivery of any prize and as a condition to being awarded any prize, we reserve the right to request that winners provide proof of eligibility (including, without limitation, confirmation of identity, and proof of age and place of legal residency). We reserve the right to disqualify you if you do not comply with any such request in a timely manner.


8. Disqualification
We have the right to disqualify you from Fury League if you: (a) fail to comply with any provision of the End User License Agreement, Terms of Use or these Rules; (b) cheat or appear to have cheated while participating in Fury League; (c) use a false email address; (d) tamper with the entry process or the operation of Fury or Fury League (or any web site relating to either of the foregoing); (e) do not meet the eligibility requirements; (f) exploiting any feature, function, weapon, tool or ability in any manner which we determine in our sole discretion to be unfair to other Fury League participants or outside intended game play functionality; or (g) entering multiple characters or accounts under different email addresses.


9. Our Determination is Final
As to all matters covered under these Rules (including without limitation determinations as to eligibility or disqualification, prize values and awarding of prizes), our determination may be made in our sole discretion and is final and binding.


10. Cancellation of Fury League
The pre-requisite for Fury League to commence is 2,000 individual players completing a minimum of ten (10) games prior to the First Contest Period. In addition, we may suspend or cancel Fury League or your participation, without notice to you, should any bug, virus, other harmful code, unauthorised intervention, glitch, technical failure, unexpected problem or tampering, or any other factor in our opinion be likely to affect proper play of Fury League or otherwise interfere with or prevent our running of Fury League as planned by us.


11. Disclaimer
We, and our affiliates, agents and employees, are not responsible for: (a) Internet, electronic, hardware, software, network or other computer-related failures, malfunctions or errors; (b) any failure or malfunction in our scoring system; (c) any disruptions, damages, losses, failures or errors that are caused by events or occurrences that are beyond our control; (d) typographical, processing, mechanical or human errors; or (e) failed, incorrect, incomplete or delayed electronic communications regardless of how caused.

YOU EXPRESSLY ACKNOWLEDGE AND AGREE THAT USE OF FURY IS AT YOUR SOLE RISK AND THAT THE ENTIRE RISK AS TO SATISFACTORY QUALITY AND PERFORMANCE IS WITH YOU. TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, FURY IS PROVIDED "AS IS", AND WE DO NOT PROVIDE AND WE HEREBY EXPRESSLY DISCLAIM ANY AND ALL WARRANTIES, EXPRESS, IMPLIED OR STATUTORY, IN CONNECTION WITH FURY, INCLUDING, BUT NOT LIMITED TO, ANY IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, CONDITION, OR NON-INFRINGEMENT.

WITHOUT LIMITING ANY OTHER TERM OF THESE RULES, TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, ALL PRIZES ARE AWARDED "AS IS," AND WE DO NOT PROVIDE AND WE HEREBY EXPRESSLY DISCLAIM ANY AND ALL WARRANTIES, EXPRESS, IMPLIED OR STATUTORY, IN CONNECTION WITH ANY PRIZES AWARDED, INCLUDING, BUT NOT LIMITED TO, ANY IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, CONDITION, TITLE, NON-INFRINGEMENT, OR ANY WARRANTY THAT ANY PRIZE WILL OPERATE USING THE VOLTAGE USED IN THE ELIGIBLE LOCATION IN WHICH YOU LEGALLY RESIDE OR PLAN TO USE SUCH PRIZE OR OTHERWISE FUNCTION AS INTENDED.


12. Waiver
Without limiting any other term of these Rules, to the fullest extent permitted by applicable law, by accepting these Rules and participating in Fury League, you hereby release us, and our affiliates, agents and employees (collectively, the "Auran Parties"), from any liability, and waive all causes of action against all Auran Parties and covenant not to make any claim against any Auran Party, in connection with or otherwise relating to your participation in Fury League (including, without limitation, any use of any prize that may be awarded to you), including without limitation all claims, damages and liabilities relating to personal injury or death or damage to or destruction of personal property.


13. Other Terms
In addition to these Rules, your rights and obligations concerning Fury and Fury League are governed by the Terms of Use, the Fury End User License Agreement, and the Privacy Policy. Please review each of these carefully, as you must agree to be bound by each of them before you may play Fury and participate in Fury League.

For clarity, any personally identifiable information collected from you in connection with Fury League will be held and used in accordance with our Privacy Policy.

Fury League and these Rules are governed by the laws of Australia, and by participating in Fury League you agree that any dispute or controversy between us relating to Fury, Fury League or these Rules will be subject to the jurisdiction of the courts of Queensland, Australia and their courts of appeal.


14. Changes to these Rules
We reserve the right to update and change these Rules at any time. Please check these Rules each time you participate in Fury League to ensure you are aware of any updates or changes. You can determine if these Rules have been revised since your last visit by referring to the "Last Updated" date at the top of this page. All changes to these Rules will be effective when posted, and your continued participation in Fury League after the posting will constitute your acceptance of, and agreement to be bound by, those updates or changes.
